Terms of Service

These terms form a binding agreement between you and SensoryWave ("we", "us") covering your use of our website, apps and services (the "Service"). By creating an account or subscribing, you agree to be bound by these terms. If you do not agree, please do not use the Service.

SensoryWave provides a library of calming audio and visual content, AI-generated music, sensory room experiences and caregiver tools. It is intended to support general wellbeing and sensory regulation; it is not a medical device and does not provide medical advice.

You must be at least 18 years old, or using the Service under the supervision of a parent or guardian who agrees to these terms. You are responsible for keeping your login credentials secure and for all activity on your account.

• We offer a Monthly plan at $9.99/month. Prices are shown on the Pricing page in US dollars.
• Payments are processed by Stripe. By subscribing you authorise recurring charges at the chosen interval until you cancel.
• Subscriptions auto-renew at the end of each billing period unless cancelled beforehand.
• You can cancel at any time from your account; cancellation takes effect at the end of the current period.

Our services come with consumer guarantees that cannot be excluded under the Australian Consumer Law, including guarantees that the Service will be provided with due care and skill and be reasonably fit for purpose. Outside those guarantees, subscription fees are generally non-refundable once a billing period has begun. If you believe you are entitled to a refund, contact hello@sensorywave.care.

You agree not to:

• Use the Service for any unlawful purpose or to harm any person.
• Generate, upload or share content that is illegal, harmful, infringing or hateful.
• Attempt to access other users' accounts or data, or to bypass our security controls.
• Resell, sublicense or otherwise commercially exploit the Service without our written consent.

Music generated through the AI Studio is created using third-party AI providers based on the prompts you submit. You receive a non-exclusive, perpetual licence to play, share and use generated tracks for personal and caregiving purposes. You may not claim authorship of the underlying AI model output as a wholly original human work, and you must not generate content that violates the providers' policies.

When you upload audio to a client profile, you confirm that you have the rights to use and share that audio. You retain ownership of your uploads; you grant us a limited licence to store and stream them back to you so the Service can function.

SensoryWave is a wellbeing tool and is not a substitute for professional medical, psychological or therapeutic advice, diagnosis or treatment. If you or someone in your care has a medical or behavioural condition, always seek the advice of a qualified health professional.

We aim to keep the Service available at all times but cannot guarantee uninterrupted access. We may modify, suspend or discontinue features at any time. We will give reasonable notice of material changes where possible.

To the maximum extent permitted by law, and subject to the consumer guarantees referred to above, our total liability to you for any claim arising out of or in connection with the Service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental or consequential loss.

You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these terms or if required by law. Sections that by their nature should survive termination (intellectual property, liability, governing law) will continue to apply.

These terms are governed by the laws of Queensland, Australia. The courts of Queensland have non-exclusive jurisdiction over any dispute arising under these terms.
